Welcome to LaMomi Fine Desserts. These Terms of Service govern your use of the LaMomi website and your purchase of products through lamomi.com.
LaMomi Fine Desserts is owned and operated by Jennifer Moghrabi as a sole proprietorship.
By accessing our website or placing an order, you agree to these Terms of Service. Please read them carefully before placing an order.
1. OUR PRODUCTS
LaMomi Fine Desserts offers handcrafted cakes and dessert products prepared for individual orders.
Because our products are handmade, minor variations in appearance, color, shape, decoration, and weight may occur. Product images are intended to represent the products and may not be an exact representation of every individual cake.
Product descriptions, available flavors, ingredients, allergens, prices, and other product information are provided on the applicable product page.
2. ORDERS
Orders are subject to product availability and acceptance by LaMomi Fine Desserts.
When you place an order, you are submitting a request to purchase the selected products. An order confirmation will be sent to the email address provided during checkout after the order has been accepted.
We reserve the right to refuse, cancel, or limit an order where necessary, including in cases of suspected fraud, incorrect pricing, product availability issues, or other circumstances that prevent us from fulfilling the order.
3. PICKUP AND LOCAL DELIVERY
Customers may select either Pickup or Local Delivery during checkout when the option is available for their location.
Customers are responsible for providing accurate contact and delivery information.
Pickup and delivery dates and time windows are selected during checkout. While we make every reasonable effort to meet the selected date and time window, circumstances outside our reasonable control may occasionally cause a delay.
For local delivery, the customer must be available to receive the order at the provided delivery address during the selected delivery window.
If a customer is unavailable at the time of delivery, additional arrangements may be required and additional delivery charges may apply where applicable.
4. ORDER CANCELLATIONS
Customers may cancel an eligible order within 15 minutes of placing the order, subject to the cancellation rules displayed during checkout.
After the applicable cancellation period has expired, an order may no longer be canceled through the standard cancellation process because products may already have entered preparation or production.
Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable law.
5. FOOD PRODUCTS AND ALLERGENS
Our products may contain or come into contact with common food allergens, including but not limited to nuts, peanuts, milk, eggs, wheat, soy, and other ingredients depending on the selected product and filling.
Customers are responsible for reviewing the ingredient and allergen information provided for the product before placing an order.
LaMomi Fine Desserts cannot guarantee that any product is completely free from allergens or cross-contact with allergens.
If you have a food allergy or dietary restriction, please contact us before placing your order.
6. PRICES AND PAYMENT
All prices are displayed in U.S. dollars unless otherwise stated.
Applicable sales taxes and other applicable charges will be calculated and displayed during checkout.
Payment must be successfully completed before an order can be fulfilled unless otherwise agreed by LaMomi Fine Desserts.
We reserve the right to correct pricing, product, or other listing errors and to cancel an order affected by such an error.
7. REFUNDS AND RETURNS
Because our products are freshly prepared food products, returns of food products are generally not accepted.
Our refund and issue-resolution procedures are described in our Refund and Return Policy.
If you receive an incorrect, damaged, or defective order, please contact us as soon as possible after receiving the order and provide the order number and relevant details. We will review the issue and determine an appropriate resolution.
Nothing in this section limits rights that cannot legally be excluded under applicable law.
8. CUSTOMER INFORMATION
You agree to provide accurate, complete, and current information when placing an order, including your name, email address, telephone number, delivery address, and any other information required to process your order.
You are responsible for reviewing your order information before completing checkout.

You may use our website only for lawful purposes.
You agree not to misuse the website, interfere with its operation, attempt to gain unauthorized access to systems or accounts, or use the website for fraudulent or unlawful purposes.

All content on the LaMomi website, including logos, branding, photographs, graphics, product descriptions, text, and other original materials, is owned by or licensed to LaMomi Fine Desserts and may not be copied, reproduced, distributed, or used without permission, except as permitted by law.

Our website and checkout may use third-party services and platforms, including Shopify and payment providers, to process orders, payments, communications, and other services.
Your use of such services may also be subject to the terms and policies of those third parties.
12. LIMITATION OF LIABILITY
